§ 1 DEFINITIONS

Working Days – days from Monday to Friday, excluding public holidays.
Consumer – a consumer within the meaning of the provisions of the Civil Code.
Buyer – any entity making a purchase in the Shop.
Regulations – these regulations.
Shop – the online shop gamerspads.com operated by the Seller at the address https://www.gamerspads.com
Seller – Adam Figaj, an entrepreneur conducting a sole proprietorship under the name Adfi Adam Figaj, Tax ID (NIP): 6172231562, REGON: 540

§ 3 TECHNICAL REQUIREMENTS

For the proper functioning of the Store, the following are required:
a device with Internet access
a web browser that supports JavaScript and cookies.
To place an order in the Store, in addition to the requirements specified in sec. 1, an active e-mail account is necessary.

§ 4 PURCHASES IN THE STORE

The prices of goods visible in the Store are the total prices for the goods, including VAT.
The Seller notes that the total price of the order consists of the following indicated in the Store: the price for the goods and, if applicable in a given case, the costs of delivery of the goods.
The goods selected for purchase should be added to the cart in the Store.
Next, the Buyer selects from the options available in the Store: the method of delivery of the goods and the payment method for the order, and also provides the data necessary to fulfill the placed order.
An order is placed at the moment its content is confirmed and the Terms and Conditions are accepted by the Buyer.
Placing an order is tantamount to concluding a sales agreement between the Buyer and the Seller.
The Seller will provide the Consumer with a confirmation of the conclusion of the sales agreement on a durable medium at the latest at the time of delivery of the goods.
The Buyer may make purchases without registration by providing their data with each potential order.

§ 5 PAYMENTS

Payment for the placed order can be made, depending on the Buyer's choice:

By a standard bank transfer to the Seller's bank account.
Cash on delivery, i.e., in cash at the moment of delivery of the goods to the Buyer.
Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.
If the Buyer chooses to pay in advance, the order must be paid for within 7 Working Days of placing the order.
The Seller informs that in the case of some payment methods, due to their specificity, paying for the order with that method is possible only immediately after placing the order.
The entity providing online electronic payment services is Blue Media S.A.

§ 6 ORDER FULFILLMENT

The Seller is obliged to deliver goods free of defects.
The order fulfillment time is 2-3 working days.
If the customer chooses payment by bank transfer or payment card, the order fulfillment time is counted from the day the Seller's bank account or settlement account is credited.
In a situation where, within one order, the Buyer has purchased goods with different fulfillment times, the order will be fulfilled within the time applicable to the goods with the longest fulfillment time.

Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
Via a courier company
Via the Polish Post

§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT

The Consumer has the right to withdraw from the contract concluded with the Seller via the Store, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day:
on which the Consumer acquires, or a third party other than the carrier and indicated by the Consumer acquires, physical possession of the goods.
on which the Consumer acquires, or a third party other than the carrier and indicated by the Consumer acquires, physical possession of the last of the goods in the case of a contract relating to multiple goods ordered by the consumer in one order and delivered separately.
of the conclusion of the contract – in the case of a contract for the supply of digital content.
To exercise the right of withdrawal, the Consumer must inform the Seller, using the data provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract by an unequivocal statement (e.g., a letter sent by post or information sent by e-mail).
To meet the withdrawal deadline, it is sufficient for the Consumer to send the information concerning the exercise of their right of withdrawal before the withdrawal period has expired.
In the event of withdrawal from the concluded contract, the Seller shall reimburse the Consumer for all payments received from them, including the costs of delivery of the goods (with the exception of the supplementary costs resulting from the Consumer's choice of a type of delivery other than the least expensive type of standard delivery offered by the Seller), without undue delay and in any event not later than 14 days from the day on which the Seller is informed of the Consumer's decision to exercise the right of withdrawal.
The Seller will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of such reimbursement.
The Seller may withhold reimbursement until they have received the goods back or until the Consumer has supplied evidence of having sent back the goods, whichever is the earliest.
The Seller requests that the goods be returned to the address: ul. Wojska Polskiego 55/9, 63-200 Jarocin without undue delay and in any event not later than 14 days from the day on which the Consumer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Consumer sends back the goods before the period of 14 days has expired.
The Consumer will have to bear the direct cost of returning the goods.
The Consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If the goods, by their nature, cannot be returned by post in the usual way, the Consumer will also have to bear the direct cost of returning the goods. The Consumer will be informed by the Seller of the estimated amount of these costs in the description of the goods in the Store or when placing the order.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right to withdraw from a distance contract does not apply to the Consumer in relation to a contract:
in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy their individualized needs.
in which the subject of the service is an item that is liable to deteriorate or expire rapidly.
in which the subject of the service is an item delivered in a sealed package which, after opening, cannot be returned due to health protection or hygiene reasons, if the package has been opened after delivery.
in which the subject of the service are items which, after delivery, due to their nature, are inseparably mixed with other items.
in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery.
for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
in which the price or remuneration depends on fluctuations in the financial market over which the trader has no control and which may occur before the end of the withdrawal period.
for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the Consumer's prior express consent before the end of the withdrawal period and after the trader has informed them of the loss of the right of withdrawal.
The right to withdraw from a distance contract does not apply to an entity other than the Consumer.

§ 9 COMPLAINTS

In the event of a defect in the goods, the Buyer has the option to complain about the defective goods on the basis of the statutory warranty regulated in the Civil Code or a guarantee, if a guarantee has been granted.
Using the statutory warranty, the Buyer may, on the principles and within the time limits specified in the Civil Code:
make a statement on price reduction
in the case of a substantial defect – make a statement on withdrawal from the contract
demand the replacement of the item with a defect-free one
demand the removal of the defect
The Seller requests that complaints based on the statutory warranty be submitted to the postal or e-mail address indicated in § 2 of the Terms and Conditions.
If it turns out that for the consideration of the complaint it is necessary to deliver the claimed goods to the Seller, the Buyer is obliged to deliver these goods, in the case of a Consumer at the Seller's expense, to the address Wojska Polskiego 55/9, 63-200 Jarocin.
If an additional guarantee has been granted for the goods, information about it, as well as its conditions, is available in the product description in the Store.
Complaints regarding the operation of the Store should be directed to the e-mail address indicated in § 2 of the Terms and Conditions.
The consideration of the complaint by the Seller will take place within 14 days.
In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:
mediation conducted by the locally competent Voivodeship Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, the procedure is free of charge. A list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
the assistance of the locally competent permanent consumer arbitration court operating at the Voivodeship Inspectorate of Trade Inspection, to which a request for consideration of the case before the arbitration court should be submitted. § 10 PERSONAL DATA

The administrator of personal data provided by the Buyer when using the Store is the Seller.
The Buyer's personal data is processed mainly on the basis of a contract and for the purpose of its implementation, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and of the Council (EU). Detailed information regarding data processing by the Seller is contained in the privacy policy posted in the Store.

§ 11 DISCLAIMERS

The Buyer is prohibited from providing content of an unlawful nature.
Each order placed in the Store constitutes a separate sales agreement and requires separate acceptance of the Terms and Conditions. The agreement is concluded for the time and purpose of fulfilling the order.
Agreements concluded on the basis of these terms and conditions are concluded in the Polish language.
In the event of a potential dispute with a Buyer who is not a Consumer, the competent court will be the court appropriate for the Seller's registered office.
None of the provisions of these terms and conditions exclude or in any way limit the Consumer's rights arising from the provisions of law.
The provisions concerning goods and the sales agreement shall apply accordingly to digital content and the contract for the supply of digital content, unless the Terms and Conditions regulate these matters separately.
